These Terms and Conditions govern the provision of direct cremation services by Direct Cremation Heathfield, a trading name of Wealden Funeral Services Ltd, ("we," "us," "our") to you ("you," "your," "the Customer"). By engaging our services, you agree to be bound by these Terms and Conditions.

  1. Definitions
    1. Direct Cremation: A cremation service where there is no formal ceremony or attendance at the crematorium.
    2. Customer: The person who instructs Direct Cremation Heathfield to provide direct cremation services.
    3. Services: The direct cremation services provided by Direct Cremation Heathfield as described on our website or as otherwise agreed.
    4. Prepayment: Full payment for the Services required before any services are rendered.
    5. Third-Party Costs: Costs incurred by Direct Cremation Heathfield on behalf of the Customer, including but not limited to, medical referee fees, doctor fees, and crematorium fees.
  2. Provision of Services
    1. Direct Cremation Heathfield will provide direct cremation services in accordance with these Terms and Conditions.
    2. We will arrange for the collection of the deceased from the location specified by the Customer, subject to logistical constraints.
    3. We will handle all necessary documentation and liaise with relevant authorities, including medical professionals and crematoria.
    4. The cremated remains will be returned to the Customer in a standard urn, unless otherwise specified and agreed upon.
    5. We will aim to complete the cremation process within a reasonable timeframe, but we cannot guarantee specific dates or times due to factors beyond our control.
  3. Prepayment
    1. All Services must be prepaid. No services will be provided until full payment has been received and cleared.
    2. Payment can be made by bank transfer or debit/credit card.
    3. The price quoted includes all services as described in the direct cremation package, unless otherwise specified.
    4. Any additional services or requests made by the Customer after payment has been received may incur additional charges, which must be paid in advance.
  4. Third-Party Costs
    1. The quoted price includes anticipated Third-Party Costs. However, in exceptional circumstances, additional Third-Party Costs may arise.
    2. In the event of additional Third-Party Costs, the Customer will be notified, and payment will be required before the cremation can proceed.
  5. Customer Obligations
    1. The Customer is responsible for providing accurate and complete information required for the cremation process.
    2. The Customer warrants that they have the legal authority to instruct Direct Cremation Heathfield to provide the services.
    3. The Customer is responsible for ensuring that all necessary documentation is provided promptly.
    4. The Customer is responsible for collecting the cremated remains within a reasonable timeframe after notification.
    5. The Customer is responsible for making the legal declaration and exonerates Direct Cremation Heathfield from any claim or delay caused by providing incomplete or inaccurate information.
  6. Cancellations and Refunds
    1. If the Customer cancels the Services before the collection of the deceased, a full refund will be issued.
    2. If the Customer cancels the Services after the collection of the deceased, a partial refund may be issued, at the discretion of Direct Cremation Heathfield, to cover costs incurred.
    3. If a death occurs that requires a Coroners investigation, and the cremation cannot be performed, a full refund will be issued less any incurred costs.
    4. Refunds will be processed within 14 days of cancellation.
  7. Liability
    1. Direct Cremation Heathfield will exercise reasonable care and skill in providing the Services.
    2. Direct Cremation Heathfield will not be liable for any indirect, consequential, or incidental loss or damage arising from the provision of the Services.
    3. Our liability for any direct loss or damage shall be limited to the total amount paid by the Customer for the Services.
    4. Nothing in these Terms and Conditions shall exclude or limit our liability for death or personal injury caused by our negligence or for fraud or fraudulent misrepresentation.
  8. Data Protection
    1. Direct Cremation Heathfield will handle personal data in accordance with the Data Protection Act 2018 and the UK GDPR.
    2. We will only use personal data for the purpose of providing the Services and as required by law.
  9. Force Majeure
    1. Direct Cremation Heathfield shall not be liable for any failure or delay in performing its obligations under these Terms and Conditions due to circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, strikes, or government regulations.
  10. Complaints
    1. Any complaints should be submitted in writing to Wealden Funeral Services Ltd, at the Registered Office Address.
    2. We will investigate all complaints and aim to respond within 14 days.
  11. Governing Law
    1. These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales.
    2. Any disputes4 arising from these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of England and Wales.
